SBS S.p.A., with registered office at Via Circonvallazione S/N, 28010 Miasino (NO), as the data controller (hereinafter the "Company" or the "Controller"), hereby provides the privacy notice in accordance with Articles 13 and 14 of Regulation (EU) 2016/679 (hereinafter, the "GDPR") concerning the processing of personal data of visitors to the website www.jaz-music.com (hereinafter, the "Site").

If you are a visitor to the Site, what types of data are processed and for what purposes?

If you are a visitor to the Site (whether registered or not), the following types of personal data will be processed for the following purposes:

  1. Navigation Data:

    • The computer systems and software procedures used to operate this Site acquire, during their normal operation, certain personal data, the transmission of which is implicit in the use of Internet communication protocols.
    • This category of data includes IP addresses or domain names of the computers and terminals used by users, URI/URL addresses (Uniform Resource Identifier/Locator) of the requested resources, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.), and other parameters related to the user's operating system and computer environment.
    • These data, necessary for the use of web services, are also processed for the purpose of: (i) obtaining statistical information on the use of services (most visited pages, number of visitors per hour or day, geographical areas of origin, etc.); and (ii) checking the correct functioning of the services offered.
    • Navigation data are processed for our legitimate interest in ensuring the security of the Site, monitoring its correct functioning, and obtaining statistics regarding its usage (Article 6, paragraph 1, letter f) of the GDPR).
  2. Data Voluntarily Provided by You:

    • In letters/emails/faxes spontaneously sent to us: the optional, explicit, and voluntary sending of your personal data to the addresses of mail, email, fax published on the Site involves the subsequent acquisition of such data, necessary to respond to the requests you have sent in relation to the Site (Article 6, paragraph 1, letter b) of the GDPR).
    • During phone calls to our phone numbers: when you contact our phone numbers or customer service, we may process the personal data you spontaneously communicate during the telephone conversation or reasonably requested by us to provide you with what is necessary (Article 6, paragraph 1, letter b) of the GDPR).
    • Through the contact form on the Site: there is a contact form on our Site (in the "Contacts" section). If you decide to use this contact form, we will collect and store your data solely for the purpose of responding to your requests (Article 6, paragraph 1, letter b) of the GDPR).

If I am a registered user on the Site, for what purposes will my personal data be processed?

If you decide to register on the Site, your personal data will also be processed for the following purposes:

  1. To execute a contract of which you are a party and pre-contractual measures adopted at your request (Article 6, paragraph 1, letter b) of the GDPR):

    • We will process your data to allow you to register on the Site, provide you with services reserved for registered users, enable you to make purchases in the Store, in execution of the Terms and Conditions of the Site and the General Sales Conditions or any other contracts and agreements of which you are a party.
  2. To provide the newsletter service (Article 6, paragraph 1, letter b) of the GDPR):

    • You can subscribe to our newsletter on the Site. Please note that our newsletter has commercial content, containing offers and promotions related to products or services provided by us.
    • Therefore, by subscribing to the newsletter, you consent to the processing of your email address for marketing purposes (direct sales, sending of advertising material, conducting market research, commercial communication) and to be contacted by email for these purposes.
  3. To comply with legal obligations (Article 6, paragraph 1, letter c) of the GDPR):

    • If you make purchases in the Store, we will process your personal data to comply with legal obligations in tax and consumer protection matters.
  4. To pursue our legitimate interest in understanding how and to what extent the Site is used by visitors (Article 6, paragraph 1, letter f) of the GDPR):

    • In order to pursue our legitimate interest in understanding how and to what extent the Site is used by visitors, we generate, also through third-party providers, statistical and aggregated data regarding the number of pages viewed on our Site, the number of visitors, and, more generally, the ways in which the Site is used, without ever identifying you.
    • To generate such statistics and aggregated data, our providers use so-called cookies (please refer to the following paragraphs 7 and 10).
  5. To pursue our legitimate interest in exercising or defending a right in judicial or extrajudicial proceedings (Article 6, paragraph 1, letter f) of the GDPR):

    • We may process your personal data to pursue our legitimate interest in exercising or defending our right in judicial or extrajudicial proceedings, even in case of non-compliance with the General Terms of Use of the Site and Sale or violations of the law.

With your optional consent, we may also process your personal data for marketing and/or profiling purposes. Regarding these processing activities, please read the following paragraphs 3 and 4.

Will you process my data for marketing purposes?

With your optional consent (Articles 130 of Legislative Decree 196/2003; Article 6, paragraph 1, letter a) of the GDPR), which can be expressed by selecting the appropriate online box, we will process your data for marketing purposes (direct sales, sending of advertising material, conducting market research, commercial communication, customer satisfaction survey). In case of consent, we may contact you by mail and email to propose the purchase of products and/or services offered by

us, present offers, promotions, and commercial opportunities, or invite you to participate in questionnaires, studies, market research, or customer satisfaction surveys. By selecting the consent box related to marketing purposes, you agree to be contacted by us via mail and email.

You can freely and at any time revoke your consent to the processing of your personal data for marketing purposes, even selectively (for example, by expressing your desire not to receive further communications via email, wanting to receive only postal communications), by making a request as indicated in the following paragraph 12.

Regarding promotional communications sent via email, you can also revoke your consent to the processing of your email address for marketing purposes by clicking on the cancellation (opt-out) link present in each promotional email.

With your optional consent (Article 6, paragraph 1, letter a) of the GDPR), expressible by selecting the appropriate online box, your personal data (including personal and contact information, as well as information about goods purchased on the Site) may be processed by SBS for profiling purposes. Profiling involves reconstructing your preferences and consumption habits, identifying your consumer profile to send you commercial offers consistent with the identified profile, particularly personalized promotional communications based on: (i) the products and services you purchased on the Site; (ii) information voluntarily provided during registration on the Site; (iii) pages visited on the Site and articles viewed on the Site. Consent for the processing of personal data for profiling purposes is entirely optional, and in case of non-provision or non-consent, the ability to register on the Site and purchase goods on the Site will not be prejudiced in any way. The consent for processing personal data for profiling purposes also extends to the details of the goods purchased on the Site or at our stores. However, data related to the details of purchased goods will be stored by SBS for profiling purposes until the revocation of the consent, and in any case, for a maximum period of 12 months, and for marketing purposes, for a maximum period of 12 months. As specified in the following paragraph 11, you may oppose the processing of your personal data for profiling purposes at any time by making a request as specified in the following paragraph 12.

Will my personal data be disclosed to third parties?
On request from the judicial authority or the police, we may have to disclose data related to visitors and registered users on the Site in cases required by law. In such cases, we may also disclose your data to lawyers or law firms, if necessary to pursue our legitimate interest in exercising or defending a right in judicial proceedings. Additionally, your data may be communicated to banks, payment institutions, and other payment intermediaries to the extent necessary for receiving a payment from you or making a payment on your behalf. If required by law, your personal data related to a purchase made on the Site may be communicated to the Revenue Agency. Your data may be communicated to the Judicial Authority upon its request in cases provided by law. Under no circumstances will your data be disclosed to third parties for marketing purposes.

Who can become aware of my data?
Our employees and collaborators involved in the management and maintenance of the Site, visitor assistance, user requests, and the management of purchases on the Store may become aware of your personal data. Additionally, the following categories of entities, acting as data processors, provide services instrumental to the performance of our business: providers of IT and logistical services, providers of outsourcing and cloud computing services, providers of analytics services (providing statistics and aggregated data on Site usage), providers of management services, external professionals and consultants, and companies entrusted with carrying out marketing activities on our behalf.

How will my personal data be processed and how long will it be stored?
Your personal data will be processed with automated and non-automated tools. Specific security measures are observed to prevent data loss, unauthorized or unlawful uses, and unauthorized access. Navigation data will be stored for a maximum period of 7 (seven) days, unless further storage is necessary for the investigation of potential computer crimes against the Site or to comply with requests from the judicial authority. If you have contacted us via letter, email, fax, or through the contact form on the Site to obtain information about the Site and the services offered, your data will be stored for a maximum of 60 days from the day we provided the requested information unless further data storage is necessary to comply with legal obligations or to exercise or defend our right in judicial proceedings. If you have contacted us regarding a purchase made on the Site through one of the contact channels on the Store, we will retain the correspondence for 10 years, as required by applicable regulations on the preservation of records and corporate correspondence. Your data collected during the Site registration will be stored until your account remains active and will be deleted immediately after the closure of your account. Data related to purchases made on the Site will be retained for 10 years, as required by applicable tax law. If you have consented to the processing of your personal data for marketing purposes, your personal data will be processed until you revoke consent for all or some contact methods. However, your contact details will be retained to pursue any other purposes for which the data was collected. Data will be processed for profiling purposes for the periods indicated in the previous paragraph 4.

Will my data be transferred outside the European Economic Area?
No, your personal data will be stored and processed exclusively within the territory of the European Economic Area. However, regarding data obtained through cookies, please read what is indicated in our Cookie Policy.

What are my rights?
You have the right to exercise, at any time and free of charge, the following rights from Articles 15 to 22 of the GDPR, including: (i) the right to access personal data (i.e., the right to obtain confirmation from us of whether or not a data processing concerning you is taking place, and, in that case, to access personal data by obtaining a copy, and information as per Article 15 of the GDPR), (ii) rectification (i.e., the right to obtain the modification of inaccurate data concerning you or the integration of incomplete data) or erasure of the data, if one of the reasons indicated in Article 17 of the GDPR exists, or the restriction of processing concerning you (i.e., the right to obtain, in cases indicated in Article 18 of the GDPR, the marking of data stored with the aim of limiting their processing in the future), (iii) the right to data portability (i.e., the right, in cases indicated in Article 20 of the GDPR, to receive from us, in a structured, commonly used, and machine-readable format, the data concerning you, and to transmit such data to another data controller without hindrance). You also have the right to object at any time, for reasons related to your particular situation, to the processing of personal data concerning you under Article 6, paragraph 1, letters e) (performance of a task carried out in the public interest or in the exercise of official authority) or f) (legitimate interest) of the GDPR, including profiling based on these provisions. If personal data are processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such purposes, including profiling to the extent that it is related to such direct marketing. Additionally, you have the right to withdraw your consent at any time when processing is based on your consent. The withdrawal of consent does not affect the lawfulness of the processing based on consent before its withdrawal.
